Terms of Engagement

1. Introduction

These Terms of Engagement ("Terms") set out the basis on which Central Otago Investigations ("we", "us", or "our") will provide private investigation services to you, our client ("you" or "your"). By engaging our services, you agree to be bound by these Terms.


2. Scope of Services
We offer a range of private investigation services, including but is not limited to investigative services such as surveillance, background checks, evidence collection, and related activities.


3a. Fee Structure
Our fees are based on the nature and complexity of the services provided. Fee details will be outlined in the engagement letter or agreement.


3b. Payment Terms
Payment is due within 14 days of receipt of invoice. Late payments may incur additional administrative costs.

 

3c. Expenses
You agree to reimburse us for reasonable and necessary expenses incurred in the course of providing the services, such as travel, accommodation, and third-party fees.

4. Confidentiality
We agree to maintain strict confidentiality regarding all aspects of the investigation and client information, except as required by law.

5. Termination
Either party may terminate the engagement with 7 days’ written notice. Fees for services rendered up to the termination date shall be due and payable upon termination.

6. Disclaimer
We provide services on an “as-is” basis. While every effort will be made to achieve the objectives of the investigation, the Investigator does not guarantee specific outcomes or results.

7. Governing Law
These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the New Zealand courts.

8. Dispute Resolution
Any disputes arising out of or in connection with this agreement shall be resolved through negotiation between the parties. If a resolution cannot be reached, the parties agree to submit the dispute to mediation before pursuing any legal action.

9. Entire Agreement
These Terms, together with the engagement letter or agreement, constitute the entire agreement between the parties and supersede all prior discussions, agreements, or understandings of any kind.

10. Communication
We will provide regular updates to the Client regarding the progress of the investigation. The Client agrees to promptly respond to requests for information or assistance related to the investigation.


11. Amendments
We reserve the right to amend these Terms from time to time. Any amendments will be communicated to you in writing and will take effect immediately upon such communication.


12. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Motor Vehicle Register – Public Disclosure Statement

Central Otago Investigations Limited authorised under section 241 of the Land Transport Act 1998, and the relevant Gazette Notice issued to members of the New Zealand Institute of Private Investigators (NZIPI), to access names and addresses of registered persons held on the Motor Vehicle Register.


The Gazette notice authorising access to this information is: 2022-au5204
The information may be accessed when the information accessed is relevant to a
matter that the Private Investigator is professionally engaged in and for one of the
following authorised purposes:

 Preparing evidence related to criminal offences;

  • The detection and investigation of suspected fraud;

  • Enforcing Court orders and judgments; and

  • When acting as a contracted agent on behalf of government agencies with

  • law enforcement functions, to assist in carrying out those functions.

Information accessed from the registry may only be used for and only retained for as
long is required to achieve the specified purpose for which it was obtained.
Any person can notify the Registrar of the Motor Vehicles Register that they do not
wish to have their name(s) and address(es) made available under an authorisation.
